  19. Computer Clubs who wish to distribute the Fixed Asset Pro 2.60 package.

  34. Individuals who wish to distribute the Fixed Asset Pro package to friends or
  35. associates may do so in accordance with the restrictions outlined in
  36. LICENSE.TXT.
  37.  
  38. Computer Clubs and User Groups wishing to add the Fixed Asset Pro package to
  39. their disk library may do so in accordance with the Distribution
  40. Restrictions listed below.

  42.    If you would like your Computer Club or User Group to be placed on our
  43.    mailing list for future upgrades to any of our products, please contact
  44.    us for complete details.  Our address, phone number, and CompuServe User
  45.    ID number is listed in DESCRIBE.TXT.

  50. As the exclusive copyright holder for Fixed Asset Pro, HammerSoft
  51. authorizes distribution only in accordance with the following restrictions.

  53. ASP Approved Vendors in good standing are hereby given permission to
  54. distribute Fixed Asset Pro package.  Non-ASP member vendors must request
  55. permission prior to distributing this package.

  65. The Fixed Asset Pro package is defined as containing all the material listed
  66. in the PACKING.LST text file.  If any files listed in the PACKING.LST text
  67. file, or the PACKING.LST file itself, are missing, then the package is not
  68. complete and distribution is forbidden.  Please contact us to obtain a
  69. complete package suitable for distribution.

  71. The Fixed Asset Pro package - including all related program files and
  72. documentation files - CANNOT be modified in any way and must be distributed
  73. as a complete package, without exception.  The PACKING.LST text file
  74. contains a list of all files that are part of the Fixed Asset Pro package.

  76.    Small additions to the package, such as the introductory or installation
  77.    batch files used by many shareware disk vendors, are acceptable.
  78.  
  79. No price or other compensation may be charged for the Fixed Asset Pro
  80. package.  A distribution fee may be charged for the cost of the diskette,
  81. shipping and handling, as long as the total (per disk) does not exceed
  82. US$10.00 in the U.S..

  84. Disk Sets & CD-ROMs:

  86. The Fixed Asset Pro package CANNOT be sold as part of some other inclusive
  87. package.  Nor can it be included in any commercial software packaging
  88. offer, without a written agreement from HammerSoft.

  90.    ASP Approved Vendors who wish to distribute the Fixed Asset Pro package
  91.    as part of a collection (such as PsL's MegaDisk set, or a CD-ROM
  92.    package) may do so provided that all the other restrictions are met.

  94.    Vendors (non-ASP Vendor Members) who wish to distribute the
  95.    Fixed Asset Pro package as part of a collection (such as PsL's MegaDisk
  96.    set, or a CD-ROM package) must obtain permission from HammerSoft
  97.    prior to beginning such a distribution.

  99.    If you wish to add any of our programs to a CD-ROM or other collection,
  100.    please check the release date of the version you have.  If the version
  101.    is over twelve (12) months old then please contact us to ensure that you
  102.    have the most current version.  This version was released in June, 1996.

  105. Disk-of-the-Month (or Subscription) Distribution:

  107. If you would like to distribute the Fixed Asset Pro package as a Disk-of-
  108. the-Month, or as part of a subscription or monthly service, then the
  109. following restrictions apply:

  111.    ASP Associate (Disk Vendor) Members in good standing are hereby given
  112.    permission to distribute the Fixed Asset Pro package under the Disk-of-
  113.    the-Month style of distribution.

  124.    Others (non-ASP Members) must contact us in advance to ensure that you
  125.    have the most current version of the software.

  127.    You cannot use a Disk-of-the-Month distribution to use up your inventory
  128.    of old (out of date) disks.  Only current versions may be shipped as
  129.    Disk-of-the-Month disks.

  131. The PRINTED User's Guide may not be reproduced in whole or in part, using
  132. any means, without the written permission of HammerSoft.  In other
  133. words, the disk-based documentation may not be distributed in PRINTED
  134. (hardcopy) form.
  135.  
  136. The Fixed Asset Pro package cannot be "rented" or "leased" to others.
  137.  
  138. You may not list any of our products in advertisements, catalogs, or other
  139. literature which describes our products as "FREE SOFTWARE".  Shareware is
  140. "Try-Before-You-Buy" software, it is not free.
  141.  
  142. Licensee shall not use, copy, rent, lease, sell, modify, decompile,
  143. disassemble, otherwise reverse engineer, or transfer the licensed program
  144. except as provided in this agreement.  Any such unauthorized use shall
  145. result in immediate and automatic termination of this license.

  147. U.S. Government Information:  Use, duplication, or disclosure by the U.S.
  148. Government of the computer software and documentation in this package shall
  149. be subject to the restricted rights applicable to commercial computer
  150. software as set forth in subdivision (b)(3)(ii) of the Rights in Technical
  151. Data and Computer Software clause at 252.227-7013 (DFARS 52.227-7013).  The
  152. Contractor/manufacturer is HammerSoft, 6074 W. Main Street, Kansas, Ohio,
  153. 44841-0205.
